Terms and Conditions

1. Definitions

In these Terms and Conditions, unless the context otherwise requires:

“Konnekt Kid”, “we”, “our”, or “us” means KONNEKT KID CORP., a corporation incorporated under the laws of Canada and operating under the trade name Konnekt Kid.

“Services” means the online English language tutoring services, educational programs, lesson packages, trial packages, gift certificates, digital resources, and related services provided by Konnekt Kid.

“Parent” means any parent, legal guardian, or other individual who purchases the Services, enters into these Terms and Conditions, or otherwise acts on behalf of a Student.

“Student” means the individual enrolled to receive the Services provided by Konnekt Kid.

“Tutor” means an English language tutor engaged by Konnekt Kid to provide Tutoring Sessions. Tutors are qualified English language professionals who hold one or more recognized English language teaching certifications, including TEFL, TESOL, or CELTA, or an equivalent qualification accepted by Konnekt Kid.

“Tutoring Session” means an individual online lesson or instructional session provided by a Tutor as part of the Services.

“Lesson Package” means a prepaid package of one or more Tutoring Sessions purchased from Konnekt Kid.

“Trial Package” means a promotional introductory package of Tutoring Sessions offered by Konnekt Kid to new Students.

“Gift Certificate” means a prepaid certificate issued by Konnekt Kid that is redeemable for the specific Services identified on the certificate, subject to these Terms and Conditions.

“Support Team” means Konnekt Kid’s administrative team responsible for scheduling, customer support, communications, and other operational matters relating to the Services.

“Website” means Konnekt Kid’s website located at www.konnektkid.com, together with any successor website operated by Konnekt Kid.

“Student Portal” means any online portal, booking system, learning platform, or other digital system designated by Konnekt Kid for accessing or administering the Services.

2. Interpretation

In these Terms and Conditions, unless the context otherwise requires:

(a) words importing the singular include the plural and vice versa;
(b) words importing any gender include all genders;
(c) references to a “person” include an individual, corporation, partnership, trust, association, government authority, or any other legal or commercial entity;
(d) references to any law or legislation include that law or legislation as amended, replaced, re-enacted, or consolidated from time to time;
(e) the words “including,” “includes,” and “such as” mean “including without limitation”;
(f) headings are provided for convenience only and do not affect the interpretation of these Terms and Conditions;
(g) promotional materials, advertisements, website content, marketing materials, or verbal statements are provided for general informational purposes only and do not form part of these Terms and Conditions unless expressly incorporated by reference;
(h) if these Terms and Conditions are translated into another language, the English version shall prevail to the extent permitted by applicable law in the event of any inconsistency or conflict between versions;
(i) Konnekt Kid may communicate with Parents and Students in languages other than English for convenience. Such communications do not modify or replace these Terms and Conditions, and only the English version shall be legally binding to the extent permitted by applicable law;
(j) unless otherwise expressly stated, all dates and times relating to a Tutoring Session shall be interpreted according to the time zone in which that Tutoring Session is scheduled. Where no specific time zone has been designated, Konnekt Kid’s designated scheduling time zone shall apply.

3. Introduction and Acceptance of These Terms

These Terms and Conditions govern the relationship between Konnekt Kid and each Parent and Student using the Services.

By purchasing a Lesson Package, Trial Package, or Gift Certificate, enrolling a Student, booking or attending a Tutoring Session, accessing or using the Student Portal, or otherwise using the Services, the Parent agrees to be bound by these Terms and Conditions.

Where the Services are purchased or used on behalf of a Student who is under the age of majority in the applicable jurisdiction, the Parent represents and warrants that they are the Student’s parent, legal guardian, or otherwise have the legal authority to accept these Terms and Conditions on the Student’s behalf.

If the Parent does not agree to these Terms and Conditions, the Parent must not purchase or use the Services.

These Terms and Conditions form a legally binding agreement between the Parent and Konnekt Kid.

4. Our Services

Konnekt Kid provides online English language tutoring services for children and teenagers through live Tutoring Sessions delivered by qualified English language Tutors.

Tutoring Sessions are delivered on demand. Konnekt Kid does not require Parents to commit to a minimum number of lessons or maintain a recurring lesson schedule. Parents may book Tutoring Sessions according to their individual learning goals and availability, subject to Tutor availability.

The Support Team coordinates lesson scheduling and other administrative matters relating to the Services.

Konnekt Kid may provide structured learning pathways, educational resources, and recommended lesson sequences. However, Parents remain free to determine the frequency of Tutoring Sessions, and no Student is required to complete any particular curriculum or course of study.

Students progress at different rates. Learning outcomes depend on many factors, including attendance, lesson frequency, participation, motivation, independent practice, and individual learning ability. Konnekt Kid does not guarantee that a Student will complete a particular curriculum within any specific period of time, achieve any particular level of English proficiency, pass any examination, or achieve any other specific educational outcome.

Konnekt Kid may modify, improve, replace, suspend, or discontinue any aspect of the Services from time to time where reasonably necessary for educational, operational, technical, legal, or business reasons.

5. Lesson Packages and Payments

Lesson Packages are prepaid and must be purchased in advance unless otherwise agreed by Konnekt Kid.

All prices are quoted in United States Dollars (USD) unless otherwise specified. Where payment is made in another currency, the amount charged may vary due to exchange rates, payment processor requirements, or other applicable transaction costs.

Lesson Packages are valid for three hundred and sixty-five (365) days from the date of purchase unless otherwise stated at the time of purchase or required by applicable law. Any unused lessons remaining after the applicable validity period will expire and will not be refundable or transferable, except where required by applicable law.

Lesson Packages may be shared between siblings within the same immediate family, provided that all participating Students are registered with Konnekt Kid and the Lesson Package is used in accordance with these Terms and Conditions.
Gift Certificates

Konnekt Kid may offer Gift Certificates that are redeemable for specific Lesson Packages or other Services identified on the Gift Certificate.

Gift Certificates purchased through certain third-party payment platforms may be subject to additional charges to reflect payment processing fees, currency conversion costs, administrative costs, taxes, or other transaction costs associated with the selected payment method.

The total purchase price, including any such additional charges, will be clearly displayed before the purchase is completed.

Unless otherwise stated on the Gift Certificate or required by applicable law, Gift Certificates are subject to these Terms and Conditions, including any applicable validity period and redemption requirements.

Trial Packages

Konnekt Kid may offer Trial Packages on promotional terms. Trial Packages are subject to any additional conditions communicated at the time of purchase and may be limited to one per Student or household.

Promotions and Discounts

Promotional offers, discounts, referral incentives, and other special offers may be modified or withdrawn at any time unless otherwise stated. Such changes do not affect purchases already completed before the effective date of the change.

Payment Methods

Konnekt Kid accepts payment using the payment methods made available at the time of purchase. The Parent is responsible for ensuring that all payment information provided is accurate and that sufficient funds are available to complete the transaction.

The Parent is responsible for any fees charged by their bank, payment provider, or card issuer unless expressly stated otherwise by Konnekt Kid.

Parents may cancel or reschedule a Tutoring Session by notifying the Support Team at least twenty-four (24) hours before the scheduled start time.

If a Tutoring Session is cancelled or rescheduled less than twenty-four (24) hours before the scheduled start time, the Tutoring Session will be treated as completed and deducted from the applicable Lesson Package, except where Konnekt Kid determines otherwise under Section 6 (Exceptional Circumstances).

If a Student does not attend a scheduled Tutoring Session without prior notice, the Tutoring Session will be treated as completed and deducted from the applicable Lesson Package.

If a Student joins a Tutoring Session after its scheduled start time, the Tutoring Session will end at its originally scheduled end time unless the Tutor, in their discretion, agrees otherwise.

If a Tutor is unable to conduct a scheduled Tutoring Session due to illness, an emergency, or another unforeseen circumstance, Konnekt Kid will make reasonable efforts to provide a replacement Tutor or reschedule the Tutoring Session at no additional cost to the Parent.

Where technical difficulties arise on Konnekt Kid’s side that materially prevent a Tutoring Session from taking place, the Tutoring Session will not be deducted from the applicable Lesson Package.

Where technical difficulties arise on the Student’s side, the Tutor and Support Team will make reasonable efforts to resolve the issue. If the technical difficulties materially prevent the Tutoring Session from taking place despite those efforts, Konnekt Kid will determine an appropriate resolution, taking into account the circumstances of the situation.

All cancellations, rescheduling requests, and attendance-related communications should be made through the Support Team.

Exceptional Circumstances

Konnekt Kid understands that unexpected situations may occasionally arise. In exceptional circumstances, including serious illness, family emergencies, or other events beyond the reasonable control of the Parent or Student, Konnekt Kid may, at its sole discretion, waive or modify the cancellation policy.

Any decision made under this Section is made on a case-by-case basis and does not create a precedent or obligation to grant similar exceptions in future circumstances.

7. Refunds

Except where required by applicable law, payments made to Konnekt Kid are non-refundable except as expressly provided in this Section.

Tutoring Packages

A Parent may request a full refund of a Tutoring Package provided that no Tutoring Sessions have been completed using that Tutoring Package.

Where one or more Tutoring Sessions have been completed, the value of each completed Tutoring Session will be recalculated at Konnekt Kid’s standard individual lesson rate in effect at the time the Tutoring Package was purchased. Any remaining balance will be refunded to the Parent.

Completed Tutoring Sessions, Late Cancellations, No-Shows, and any unused lessons remaining after the expiry of a Tutoring Package are not refundable.

Trial Packages

A Trial Package will be refunded if the refund request is received within seven (7) days following the final Trial Session. After that period, the Trial Package becomes non-refundable.

Gift Certificates

Unless required by applicable law, Gift Certificates are non-refundable once purchased.

Where a refund of a Gift Certificate is permitted, it may only be issued to the original purchaser using the original payment method, where reasonably practicable, and in the same currency in which the original payment was made.

Approved refunds will ordinarily be processed within fourteen (14) business days.

Konnekt Kid is not responsible for any differences arising from currency exchange rates, payment processor fees, bank charges, or other transaction costs incurred by third parties.

Nothing in this Section limits any rights or remedies that cannot legally be excluded or limited under applicable law.

8. Parent and Student Responsibilities

Parents and Students are expected to use the Services in a respectful, lawful, and responsible manner.

The Parent is responsible for providing accurate and up-to-date information required for the delivery of the Services and for promptly notifying the Support Team of any changes to that information.

The Parent is responsible for ensuring that the Student has access to a suitable device, a stable internet connection, and an appropriate learning environment for each Tutoring Session.

The Student is expected to attend Tutoring Sessions on time, participate respectfully, and make reasonable efforts to engage in the learning process.

Where appropriate having regard to the Student’s age and level of independence, the Parent is responsible for providing reasonable supervision during or in connection with the Services.

The Parent is responsible for informing Konnekt Kid of any learning needs, accessibility requirements, medical information, or other circumstances that may reasonably affect the Student’s participation in the Services.

Parents and Students must not:

(a) use the Services for any unlawful, fraudulent, or unauthorized purpose;
(b) impersonate another person or provide false or misleading information;
(c) interfere with or disrupt the operation of the Services or the Student Portal;
(d) engage in abusive, threatening, discriminatory, harassing, or otherwise inappropriate conduct towards any Tutor, Student, or member of the Support Team;
(e) copy, reproduce, distribute, publish, record, modify, create derivative works from, or otherwise use any lesson materials, recordings, educational resources, or other proprietary content provided by Konnekt Kid except as expressly permitted in writing.

The Parent is responsible for maintaining the confidentiality of any login credentials associated with the Student Portal and for all activity occurring under those credentials.

Language learning is a collaborative process. The Parent acknowledges that a Student’s progress depends in part on attendance, motivation, independent practice, and, where appropriate, parental support.

9. Konnekt Kid Rights and Responsibilities

Konnekt Kid is committed to providing high-quality online English language tutoring services delivered by qualified English language Tutors.

Konnekt Kid will make reasonable efforts to schedule Tutoring Sessions in accordance with the Parent’s preferences, subject to Tutor availability.

Konnekt Kid may assign, replace, or change a Tutor at any time where reasonably necessary, including for operational, scheduling, educational, or other legitimate business reasons.

Konnekt Kid may modify, improve, replace, suspend, or discontinue lesson materials, educational resources, teaching methods, technology, administrative processes, or any other aspect of the Services where reasonably necessary.

Where a material change to the Services is likely to have a significant impact on Parents or Students, Konnekt Kid will make reasonable efforts to provide advance notice.

Konnekt Kid may suspend or discontinue the provision of the Services where reasonably necessary, including where the Parent or Student:

(a) materially breaches these Terms and Conditions;
(b) engages in abusive, threatening, discriminatory, harassing, or otherwise inappropriate conduct;
(c) repeatedly disrupts Tutoring Sessions or interferes with the operation of the Services;
(d) engages in unlawful activity; or
(e) creates or contributes to a situation that Konnekt Kid reasonably believes may compromise the safety, privacy, dignity, or well-being of any Student, Tutor, member of the Support Team, or other participant.
Where circumstances require immediate action, Konnekt Kid may suspend the Services without prior notice.
Nothing in this Section limits any refund rights or other rights that cannot be excluded or limited under applicable law.

10. Intellectual Property

All intellectual property rights in the Services and all materials provided by Konnekt Kid, including without limitation curricula, lesson plans, worksheets, presentations, activities, educational resources, videos, recordings, graphics, designs, logos, trademarks, the Website, the Student Portal, and all related content, are owned by or licensed to Konnekt Kid and are protected by applicable intellectual property laws.

Subject to these Terms and Conditions, Konnekt Kid grants the Parent and Student a limited, non-exclusive, non-transferable, and revocable licence to access and use such materials solely for the Student’s personal, non-commercial educational purposes.

Except as expressly permitted in writing by Konnekt Kid, the Parent and Student must not:

(a) copy, reproduce, distribute, publish, sell, sublicense, or commercially exploit any materials provided by Konnekt Kid;
(b) modify, adapt, translate, reverse engineer, create derivative works from, or otherwise alter any materials or content provided by Konnekt Kid;
(c) upload, share, transmit, or make available any lesson recordings, educational materials, or other proprietary content to any third party or public platform; or
(d) remove, alter, or obscure any copyright, trademark, or other proprietary notices.
Nothing in these Terms and Conditions transfers ownership of any intellectual property rights from Konnekt Kid to the Parent or Student.

Any suggestions, comments, ideas, or other feedback voluntarily provided to Konnekt Kid regarding the Services may be used by Konnekt Kid without restriction or obligation to provide compensation, unless otherwise agreed in writing.

11. Privacy and Communications

Konnekt Kid collects, uses, stores, and processes personal information in accordance with its Privacy Policy and applicable privacy laws.

Tutoring Sessions are ordinarily recorded as part of Konnekt Kid’s safeguarding, quality assurance, tutor training, service improvement, and dispute resolution procedures. Parents are informed of recording through the online meeting platform at the time the recording begins, and additional information regarding the collection, use, retention, and protection of recordings is provided in Konnekt Kid’s Privacy Policy.

Where appropriate and at Konnekt Kid’s discretion, excerpts from a Tutoring Session recording may be shared with the Parent for educational, support, quality assurance, or dispute resolution purposes.

Unless required to be retained for an active complaint, safeguarding concern, legal obligation, or ongoing investigation, Tutoring Session recordings are retained for seven (7) days from the date of the Tutoring Session and are then securely deleted.

If a Parent wishes to raise a concern, complaint, or dispute relating to a Tutoring Session that may require review of the session recording, the Parent must notify Konnekt Kid within seven (7) days of the relevant Tutoring Session. Where a concern, complaint, or dispute is received before the recording is scheduled for deletion, Konnekt Kid may retain the recording for as long as reasonably necessary to investigate and resolve the matter.

Parents are responsible for ensuring that the contact information provided to Konnekt Kid remains accurate and up to date.

Konnekt Kid may communicate with Parents regarding the Services by email, telephone, text message, or any other communication method designated by Konnekt Kid.

Parents consent to receiving communications that are reasonably necessary for the administration and delivery of the Services, including lesson scheduling, reminders, account information, service updates, responses to support requests, and other operational communications.

Where permitted by applicable law, Konnekt Kid may also send promotional or marketing communications. Parents may withdraw their consent to receive promotional or marketing communications at any time. Withdrawal of such consent does not affect communications that are necessary for the administration and delivery of the Services.

12. Safeguarding and Student Safety

The safety and well-being of Students are a priority for Konnekt Kid. Konnekt Kid is committed to providing a professional, respectful, and supportive online learning environment for every Student.

Tutors are expected to maintain appropriate professional boundaries with Students at all times. Tutoring Sessions are intended solely for educational purposes, and Tutors must conduct themselves in a manner that is appropriate for working with children and young people.

Tutors must not engage in behaviour that is inappropriate, offensive, discriminatory, intimidating, harassing, or abusive. Konnekt Kid does not tolerate any conduct that may compromise the safety, dignity, or well-being of a Student.

Tutors are not permitted to discuss topics that are inappropriate for the Student’s age or unrelated to the educational purpose of the Tutoring Session. Without limitation, this includes discussions relating to politics, religion, sexual content, illegal activities, hate speech, or other subjects that a reasonable Parent would consider unsuitable for a child’s educational lesson, unless the Parent has specifically requested such content for legitimate educational purposes and Konnekt Kid has approved its inclusion.

Tutors must not request personal contact information from Students, communicate with Students outside the platforms or communication channels approved by Konnekt Kid, or encourage private relationships with Students or their families.

Parents are encouraged to report any concern regarding a Tutoring Session or a Tutor to the Support Team as soon as reasonably practicable. Konnekt Kid will review all safeguarding concerns promptly and may investigate, suspend, or terminate a Tutor’s access to the Services where appropriate.

Where a Tutor reasonably believes that continued use of a Student’s camera or microphone could compromise the privacy, dignity, safety, or well-being of the Student or another individual, the Tutor may temporarily disable the Student’s camera or microphone. This authority is intended to be exercised only where reasonably necessary, including where confidential, sensitive, or inappropriate information or activity becomes visible or audible, or where another situation arises that the Tutor reasonably believes should not be visible or audible during the Tutoring Session. The Tutor will immediately notify the Support Team of the situation. The Support Team will promptly communicate with the Parent and, where appropriate, work with the Parent to determine the most appropriate way to continue or conclude the Tutoring Session.

Nothing in this Section limits a Parent’s rights under applicable law or Konnekt Kid’s ability to take any action it reasonably considers necessary to protect the safety and well-being of a Student.

13. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits any liability that cannot be excluded or limited under applicable law.

To the fullest extent permitted by applicable law, Konnekt Kid shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of opportunity, loss of data, loss of goodwill, or any other indirect or consequential loss arising out of or in connection with the Services or these Terms and Conditions.

Konnekt Kid is not responsible for interruptions, delays, or failures in the delivery of the Services resulting from internet outages, failures of third-party communication platforms, power outages, equipment failures, cyberattacks, or other circumstances beyond Konnekt Kid’s reasonable control.

Konnekt Kid is not responsible for technical issues arising from the Parent’s or Student’s equipment, internet connection, software, devices, or network configuration.

Parents acknowledge that participation in the Services is voluntary and that each Student’s learning outcomes depend on many factors beyond Konnekt Kid’s reasonable control, including attendance, participation, motivation, independent practice, individual learning ability, and support provided by the Parent.

To the fullest extent permitted by applicable law, Konnekt Kid’s total liability arising out of or relating to the Services or these Terms and Conditions shall not exceed the total amount paid by the Parent to Konnekt Kid for the Services giving rise to the claim.

Nothing in these Terms and Conditions limits or excludes Konnekt Kid’s liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, or any other liability that cannot be excluded or limited under applicable law.

14. Force Majeure

Konnekt Kid shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms and Conditions where such delay, interruption, or failure results from circumstances beyond its reasonable control.

Such circumstances may include, without limitation, natural disasters, severe weather, fire, flood, war, armed conflict, terrorism, civil unrest, labour disputes, epidemics, pandemics, government actions, changes in law, internet or telecommunications failures, power outages, cyberattacks, failures of third-party service providers, or any other event beyond Konnekt Kid’s reasonable control.

Where reasonably practicable, Konnekt Kid will make reasonable efforts to notify affected Parents of any disruption caused by a Force Majeure event and to resume the Services as soon as reasonably possible.
If a Force Majeure event prevents a scheduled Tutoring Session from taking place, Konnekt Kid will make reasonable efforts to reschedule the Tutoring Session at a mutually convenient time.

Nothing in this Section requires Konnekt Kid to perform any obligation where performance is prevented or materially affected by a Force Majeure event. However, Konnekt Kid will use reasonable efforts to minimize the impact of the Force Majeure event on the delivery of the Services.

15. Suspension and Termination

A Parent may discontinue the Services at any time by notifying Konnekt Kid’s Support Team. Any applicable refund will be determined in accordance with Section 7 (Refunds).

Konnekt Kid may suspend or terminate the provision of the Services immediately where reasonably necessary, including where:

(a) the Parent or Student materially breaches these Terms and Conditions;
(b) the Parent or Student engages in abusive, threatening, discriminatory, harassing, or unlawful conduct towards a Tutor, another Student, or any member of the Support Team;
(c) the Parent or Student repeatedly disrupts Tutoring Sessions or otherwise interferes with the delivery of the Services;
(d) payment remains outstanding after Konnekt Kid has provided reasonable notice and an opportunity to make payment; or
(e) Konnekt Kid reasonably believes that continuing to provide the Services would be unsafe, unlawful, or otherwise inappropriate.

Where reasonably practicable, Konnekt Kid will notify the Parent before suspending or terminating the Services and will explain the reasons for its decision.

If Konnekt Kid terminates the Services for reasons other than the Parent’s or Student’s breach of these Terms and Conditions, any unused balance of the applicable Lesson Package will be refunded in accordance with Section 7 (Refunds).

Termination of the Services does not affect any rights or obligations that arose before the date of termination, including any payment obligations, refund rights, or other rights and obligations that have already accrued under these Terms and Conditions.

Upon termination, the Parent’s and Student’s right to access the Student Portal and any other parts of the Services may be suspended or discontinued, except to the extent required by applicable law or expressly agreed by Konnekt Kid.

16. Changes to the Services and Terms

Konnekt Kid may update, modify, expand, suspend, or discontinue any aspect of the Services from time to time in order to improve the Services, comply with legal or regulatory requirements, respond to operational needs, or for other legitimate business reasons.

Konnekt Kid may amend these Terms and Conditions from time to time. The most current version will be made available on the Website and will indicate its Effective Date.

Where a change to these Terms and Conditions materially affects the rights or obligations of Parents, Konnekt Kid will make reasonable efforts to provide advance notice using the contact information provided by the Parent or by publishing a notice on the Website.

Unless required by applicable law or unless the amendment is beneficial to the Parent, any material amendment to these Terms and Conditions will apply only to Lesson Packages, Trial Packages, Gift Certificates, or other Services purchased on or after the Effective Date of the amendment.

The Parent’s continued purchase or use of the Services after the Effective Date of an amendment constitutes acceptance of the revised Terms and Conditions with respect to any Lesson Packages, Trial Packages, Gift Certificates, or other Services purchased on or after that Effective Date.

17. General Provisions

Entire Agreement

These Terms and Conditions, together with any documents expressly incorporated by reference, constitute the entire agreement between the Parent and Konnekt Kid regarding the Services and supersede all prior discussions, representations, understandings, negotiations, and agreements relating to the same subject matter.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

No Waiver

No failure or delay by Konnekt Kid in exercising any right or enforcing any provision of these Terms and Conditions shall constitute a waiver of that right, provision, or any other right or provision.

Assignment

The Parent may not assign, transfer, or otherwise dispose of any rights or obligations under these Terms and Conditions without Konnekt Kid’s prior written consent.

Konnekt Kid may assign, transfer, or otherwise deal with its rights and obligations under these Terms and Conditions as part of a corporate reorganization, merger, acquisition, sale of assets, or other legitimate business transaction, provided that such assignment does not materially reduce the Parent’s rights under these Terms and Conditions.

Electronic Acceptance

The Parent acknowledges that these Terms and Conditions may be accepted electronically and that such acceptance has the same legal effect as a handwritten signature, to the fullest extent permitted by applicable law.

Notices

Any notice or communication relating to these Terms and Conditions or the Services may be provided by email or by any other communication method designated by Konnekt Kid.

Parents are responsible for ensuring that their contact information remains accurate and up to date.
Unless Konnekt Kid receives notice that a communication could not be delivered, a notice shall be deemed received when it is sent.

Survival

Any provisions of these Terms and Conditions which, by their nature, are intended to survive termination, including those relating to intellectual property, refunds, limitation of liability, dispute resolution, accrued rights and obligations, and any other provisions intended to survive termination, shall remain in full force and effect following the termination of the Services.

18. Governing Law and Contact Information

These Terms and Conditions, and any dispute, claim, or controversy arising out of or relating to the Services or these Terms and Conditions, shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Nothing in these Terms and Conditions limits any mandatory rights or remedies available to consumers under applicable law that cannot legally be excluded or limited.
